Andrew W. Smith is a partner at Bates Carey Nicolaides LLP. He serves as coverage and litigation counsel to insurers throughout North America, Bermuda, and London in professional liability coverage (including D&O, E&O, and EPL coverage), general liability coverage and mass tort litigation. He focuses on counseling insurers on claims arising from securities class action litigation, derivative litigation, ERISA litigation, mass tort litigation, and commercial litigation.
For over a decade, Andrew has represented primary and excess insurers in connection with many of the most severe D&O and E&O industry exposures, including the credit crisis, subprime meltdown, stock options backdating, mutual fund scandal, contingent commissions, analyst conflicts, and IPO laddering, among others. Andrew has also represented insurers in connection with coverage litigation, mass tort, product liability, and general commercial litigation. He has advised insurers on underwriting issues and new product development, and has counseled insurers on claims administration, risk management and risk engineering issues.
He received a J.D. from DePaul University College of Law in 1996; and a B.A. in English Literature from the College of St. Francis in 1992.
